By registering an account ("Account"), accessing our platform ("Platform"), downloading any application, or participating in any competitions ("Competitions"), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms"). You also confirm that you are authorized and capable of accepting these Terms.
Important Notice: Your participation does not establish Themis-Tech Inc. as a provider of Competitions or services offered by third-party developers.
Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, and revocable license to:
Access and use the Platform and its content ("Content") via supported web browsers or mobile devices.
Use platform avatars.
This license is solely for your personal entertainment purposes.
We reserve the right to amend these Terms at any time. We will notify users of material changes via a website notice, and such changes will take effect immediately upon posting. Your continued use of the Platform after any changes have been made constitutes your acceptance of the modified Terms.
To register an Account or participate in Competitions, you must:
Be a natural person who is at least 18 years old (or the age of majority in your jurisdiction).
Have the legal capacity to enter into contracts.
Be physically located in a jurisdiction where participation is legally permitted.
Maintain compliance with all Terms at all times.
Prohibited Jurisdictions (as of last update):
United States: Delaware, Louisiana, Maryland, Montana, Tennessee, Indiana, Maine, Texas.
Any other region where Competitions violate local laws.
Only one Account per individual is permitted.
You must notify us immediately if:
You become aware of any unauthorized use of your Account or any other breach of security.
You discover that multiple accounts are associated with you.
You are solely responsible for:
Maintaining the confidentiality of your login credentials.
All activities conducted through your Account.
Accounts with no recorded transactions for 30 consecutive months will have their balances remitted in accordance with applicable law and may be subject to closure.
You agree to participate personally for recreational purposes only and not to engage in any fraudulent, collusive, or other improper activities, including but not limited to the use of bots or automated tools, or the sale or trade of merchandise or winnings.
Cash Players must maintain accurate personal and payment information and consent to identity verification checks.
Bonus Funds:
Can only be used for Competition entries.
Will be forfeited upon withdrawal requests or after 60 days of inactivity.
Withdrawals: Will be processed within 90 days via checks or the original payment method. Digital assets and Bonus Funds are excluded from withdrawals. Processing may be delayed for compliance investigations.
Taxes: Winners bear full responsibility for any tax obligations arising from their winnings.
Copyright infringement claims must include the authorized representative's signature, a description of the copyrighted work, the location of the infringing material, contact information, a statement of good faith belief, and a declaration of accuracy under penalty of perjury.
You grant us a perpetual, worldwide, royalty-free license to use all content you submit. You also waive your moral rights in such content where permissible by law.
All in-game assets ("Digital Assets") remain our exclusive property. You receive only a limited, non-transferable license to use them.
To the maximum extent permitted by law, we exclude liability for any direct or indirect damages (e.g., data loss, lost profits), third-party conduct or content, service interruptions, or unauthorized access.
You agree to indemnify and hold us harmless against all claims, damages, and expenses arising from your violation of these Terms, illegal use of the Services, or infringement of any third-party rights.
Governing Law: Nevada state law (excluding conflict of laws principles).
Mandatory Arbitration: Any dispute will be administered by the American Arbitration Association (AAA) under its Commercial Rules. The venue will be in the United States. Only individual claims are permitted (class action waiver), and the arbitrator's decision is final and binding.
You agree to resolve disputes on an individual basis and waive any right to participate in class, consolidated, or representative actions.
Force Majeure: We are not liable for events beyond our reasonable control.
Severability: If any provision is found invalid, the remaining provisions will remain in effect.
Assignment: We may transfer our rights under these Terms without your consent.
Entire Agreement: These Terms constitute the entire agreement between you and us, superseding all prior agreements.
